A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

[2] On May 19, 2006, the Defendant was sentenced to imprisonment with prison labor for a crime of fraud at the Incheon District Court on May 19, 2006, and completed the execution of the sentence on August 4, 2006.

On April 22, 2009, the Defendant stated that: (a) around April 22, 2009, at the time when the Defendant and C (the first conviction was issued in this case); (b) KRW 902,00,000 cashier’s checks issued by the Masung Agricultural Cooperative that C forged, issued by the Masung Agricultural Cooperative (C/C No. 5896097) were the true check.

In collusion with C on April 22, 2009, the Defendant: (a) suggested that the victim’s name was actually issued one copy of the check issued by Hongcheon-gun, Hongcheon-do, Hongcheon-do, by suggesting that at around 16:00,000 won of the check issued by Hongcheon-gun, the Defendant deceptioned the victim; (b) received KRW 18,000,000 from the victim, and received KRW 82,00,000 from the victim’s cremation; and (c) from that time, the Defendant knew the victims and received money and valuables by using the forged checks as above, from April 23, 2009 until April 23, 2009.

The Defendant, in collusion with C on April 23, 2009, purchased one cigarette at G convenience stores operated by the victim FF in the wife population E on April 23, 2009, and attempted to deliver a forged cashier’s check as the price for tobacco as if it was duly issued, thereby deceiving the said F and to receive tobacco and scams. However, the F did not appear to have a form of preventing reproduction on the said check, and the Defendant did not intend to refuse to receive the said check with the knowledge that the check was forged.
