A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
From January 13, 2009 to September 12, 2010, the Defendant served as a public official in charge of budget and accounting in the Gwangju Fire Station, and requested payment by the victim Gwangju Metropolitan City, such as wages and allowances of public officials belonging to the said fire station, after obtaining approval from its superior, by preparing a draft of the disbursement resolution on the local government finance expenditure of the said fire station, and managing other “credit card settlement exclusive account” and “cash account other than revenue and expenditure.”
1. On January 20, 2009, the Defendant prepared a false official document, for the purpose of exercising the Defendant’s benefit on January 2, 2009, based on the Information System for Personnel Management of Fire-Fighting Officials (hereinafter “the Benefit System”), the amount recorded in the Defendant’s wage column was changed to his PC to 3,04,540 won, and then printed out the amount recorded in the Defendant’s wage column to A4.
The Defendant continued to prepare and print out the disbursement resolution form in the “e-Support System” which is a local financial system, and then attached the disbursement resolution to the disbursement resolution to which the Defendant’s wage amount was modified, and then affixed the Defendant’s seal, who is the drafter, affixed the Defendant’s seal, and made the superior, E, and F false statement of the disbursement resolution on January 2, 2009 under the name of the Defendant, etc., who is an official document, affixed their official seal and affixed their respective seals to approval.
In addition, from around that time to August 20, 2010, the Defendant prepared 15 copies of the disbursement resolution in the same manner at the same place, such as the list of crimes (1) in attached Form 1, respectively.
2. The Defendant for the uttering of a false official document is well-grounded on January 2009, which was an official document prepared in falsity, at the same time and place as in paragraph (1).
