A defendant shall be punished by imprisonment for six months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

The Defendant, the owner of the Nam-gu Incheon Metropolitan City C 202, prepared a false lease contract as if the Defendant leased the above house, and then filed an application for a loan to a financial institution for a loan on a deposit basis, and conspired with D to take over the loan by taking advantage of the loan as if it did not have leased the above house.

On April 28, 2014, the Defendant and D drafted a false contract for a lease with the content that “the Defendant leases the above house owned by D with the deposit amount of KRW 70 million, the lease term of KRW 50 million from May 20, 2014 to May 19, 2016,” at the F Authorized Brokerage Office located in Nam-gu Incheon, Nam-gu, Incheon. The Defendant and D were issued a false certificate of employment, the health insurance qualification certificate, and the certificate of income tax source collection.

On May 20, 2014, the Defendant filed an application for the lease loan at a new bank Incheon Mart branch located in the Nam-gu Incheon Dong-gu Incheon Metropolitan City, with the staff in charge of the lease loan of the victim bank, submitting a false certificate of employment, health insurance qualification confirmation, income tax collection confirmation, lease contract.

On May 20, 2014, the Defendant conspired with D, by deceiving the victim as above, and by receiving 56 million won from the victim to the Cit Bank account under the name of D as a loan for Jeonse loan on May 20, 2014, the Defendant acquired the money by money.
