A defendant shall be punished by imprisonment for four months.

Punishment of the crime

[2014 Highest 1982] On May 8, 2014, the Defendant was sentenced to a suspended sentence of two years for the purpose of fraud at the Seoul Eastern District Court on imprisonment with prison labor for six months, and the judgment became final and conclusive on May 16, 2014.

On April 28, 2014, the Defendant made a false statement that he would deliver a performance ticket to the victim C by depositing money into the victim C.

However, even if the defendant receives money from the victim, he did not have the intention or ability to deliver performance diskettes.

Nevertheless, the Defendant received 120,000 won from the victim as the price for public performance diskettes from the account in the name of D on the same day.

1. On April 24, 2014, the Defendant against the victim E made a false statement to the victim E by using the Kakakao Kakao Kakao Ma to sell the price to KRW 120,000 per head of the X-gu Kao Ma.

However, since the defendant did not have X-gu contact diskettes, even if he received the above money from the victim, he did not have the intention or ability to send it to the victim.

Nevertheless, on April 25, 2014, the Defendant received 120,000 won from the victim as the price for contact diskettes.

2. The Defendant, on May 7, 2014, by deceiving the victim H from the GPC room as indicated in the foregoing paragraph (1) using the Kakakakao Kakao Kakao Me, and then, by deceiving the victim in the same manner as indicated in the foregoing paragraph (1), was remitted KRW 240,000 to the victim as the price for contact diskettes on the same day from the victim.

3. Fraud against victim I;

A. On May 7, 2014, the Defendant, at the GPC room as indicated in the foregoing paragraph (1) on May 7, 2014, by using text messages to the victim I and by deceiving the victim in the same manner as described in the foregoing paragraph (1), and then transferred KRW 390,000 as the price for contact diskettes on the same day from the victim.

B. On May 8, 2014, the Defendant is above the GPC bank.
