Punishment of the crime

Defendant

A is a person operating Jhonam branch that sells agricultural machinery, such as a wide-area spraying machine produced by J(J) from 209, Nam-gu, Nam-gu, Gwangju.

Defendant

D Corporation (hereinafter “D Corporation”) is an assistant business entity selected as the “K business in 2007” implemented by the Masung-gun. Defendant B is the actual operator of the said D Corporation as of December 2007, and Defendant C was a representative director of the said D Corporation from December 2007 to April 2008. Defendant H Corporation (hereinafter “H Corporation”) is an assistant business entity selected as the “K business in 2007” implemented by the Y-gun.

E The head of M who participated in the above H corporation is a current adviser, and F is a director of H corporation of the above federation, and G was delegated by H corporation with the purchase and operation of wide-area spraying among the total L business of the above federation.

1. Defendant A, B, and C’s violation of the Act on the Budgeting and Management of Subsidies and Management of Subsidies and fraud K businesses are 20 million won when the project cost of KRW 200 million was set and 20 million was paid by the subsidized project operator (hereinafter “self-payment”). Other project cost is paid by the State (hereinafter “State cost of KRW 80 million”) and the local government (including Do cost of KRW 16 million, military expense of KRW 64 million) with 40% each, and the local government (including Do cost of KRW 16 million, military expense of KRW 64 million). In order to receive the above subsidy, evidence is submitted that the subsidized project operator paid all self-payment to the subsidized project operator.

Defendant

A agreed with Defendant B and C to bear 40 million won as a condition for the purchase of metropolitan spraying machines.

Accordingly, on January 15, 2008, A paid the self-paid amount to be paid by the D Corporation by remitting the amount of KRW 40 million to its own agricultural bank account under the name of D Corporation.

Nevertheless, the Defendants, at around January 31, 2008, shall prepare and submit an application for subsidies, along with passbook payments, etc., as if they actually borne by the said D Corporation, to the Gisung-Gun Office, along with the documents on deposits without passbook payments, etc., and 160,000 from the Gisung-Gun Office on February 4, 2008.
