1.The judgment of the first instance shall be modified as follows:

The defendant shall pay to the plaintiff KRW 49,423,159 and KRW 45,50,789 among them.

Reasons

1. Facts of recognition;

A. (1) On January 16, 2009, the Plaintiff and the Defendant concluded a lease agreement with respect to the amount of KRW 50 million, KRW 170,00,000 (in addition to value-added tax, KRW 50,000,000, KRW 170,000 for monthly rent (in addition to value-added tax, five days for each month), from February 5, 2009 to February 4, 201, with respect to the amount of KRW 501, KRW 118.90,000 for May 5, 2009, which is owned by the Defendant (hereinafter referred to as each housing unit).

On February 5, 2009, the Plaintiff paid a deposit of KRW 50 million to the Defendant, and completed the registration of the establishment of chonsegwon, which is the registration office of Suwon District Court, under Article 13281 of the receipt of the Suwon District Court's Port Office, with respect to subparagraph 501 and 502 on the same day, until February 5, 201.

The Plaintiff paid KRW 50,000,000 to the Defendant around March 28, 2009. (3) On August 25, 2009, the Plaintiff and the Defendant concluded a lease agreement with the Defendant as to KRW 30,000,000 for KRW 130,000 for monthly rent of KRW 402,127.14 square meters (hereinafter “402,”), which are owned by the Defendant, from KRW 1.3 million to KRW 1.201,201,000 for monthly rent of KRW 1301.200.

On September 25, 2009, the Plaintiff paid KRW 30 million to the Defendant the deposit.
