1. The Defendant shall pay to the Plaintiff KRW 51,327,754, and KRW 3,992,370, out of the above amount, from November 1, 2013 to the day of full payment.
Reasons
1. Facts of recognition;
A. (1) On January 16, 2009, the Plaintiff and the Defendant concluded a lease agreement with respect to the amount of deposit KRW 50 million, monthly rent of KRW 170,000 (in addition, 500,000 won per month), and from February 5, 2009 to February 4, 201, with respect to the amount of KRW 501, 118.90 square meters, 502, and 127.14 square meters (hereinafter “instant No. 501 and 502”) of the Suwon-si Suwon-si, the Defendant owned by the Defendant.
On February 5, 2009, the Plaintiff paid a deposit of KRW 50 million to the Defendant on the same day, and completed the registration of establishment of chonsegwon, which is the term “the deposit of KRW 50 million and its duration until February 5, 201,” under Article 13281 of the receipt of the Suwon District Court's Registry of Mawon District Court as to subparagraphs 501 and 502 of this case on the same day.
(2) On February 17, 2009, the Plaintiff and the Defendant concluded a lease agreement with regard to KRW 30 million, monthly rent of KRW 1.5 million (in addition, KRW 30,000,000, monthly rent of KRW 1.5 million, from March 1, 2009 to February 28, 201, which is owned by the Defendant (hereinafter “instant No. 403”).
On March 28, 2009, the Plaintiff paid KRW 50 million to the Defendant.
(3) On August 25, 2009, the Plaintiff and the Defendant concluded a lease agreement with regard to KRW 30 million, monthly rent of KRW 1 million (in addition tax, KRW 30,000,000 from November 1, 2010 to October 31, 201), which is the Defendant’s ownership (hereinafter “instant subparagraph 402”), as to KRW 402,000,000, monthly rent of KRW 1 million: Provided, That the term of lease stipulated in paragraph (2) of the special agreement as “from November 1, 2010 to KRW 1.2 million”; and the term of lease from November 1, 2009 to October 31, 201.
On September 25, 2009, the Plaintiff paid KRW 30 million to the Defendant the deposit.
(4) The main contents of each of the instant lease agreements are as follows: (a) each of the instant lease agreements, including each of the instant lease agreements, (b) Nos. 402, 403, 501, and 502.
(1) Article 3: A lessee shall change the use or structure of the above real estate, or sublease or transfer the right of lease without consent of the lessor.
