1. The Defendant is as of August 21, 2013 with respect to the Plaintiff’s share of 1/3 of the 47,603 square meters of C Forest land in Chungcheongbuk-gun.
Reasons
1. Basic facts
A. On April 23, 1971, registration of preservation of ownership has been made with respect to C Forest land of 47,603 square meters (hereinafter “the instant forest”).
1) 1F/3 E/3 of equity in 1D2/3 of co-owners;
B. F shares 1) The FF died on October 1, 1985. 2) On April 7, 1995, the cause of the registration was made on March 10, 1983 on the part of F shares among the forest land in this case, and the entire transfer registration was made on March 10, 1983.
C. D’s share 1) The said D’s share died on January 17, 1974. 2) On December 12, 2011, the cause for the registration of D’s share out of the instant forest land was inherited on January 17, 1974 by inheritance of property due to a consultation and division, and the entire registration of transfer was completed.
3) On December 20, 2011, the reason for the registration of the said G shares was made on December 20, 201 and the reason for the registration was traded on December 20, 2011. 4) G was convicted of the following facts constituting a crime (to be sentenced to imprisonment with prison labor for 10 months, 2012No165: Cheongju District Court Decision 2012No1165: 10 months, 10 months, 2 years of suspended sentence) and the above judgment became final and conclusive.
Criminal facts
The size of 47,603 square meters of the C forest land in the Chungcheongbuk-gun is the forest land owned by the same clan that the injured clan held in title for each one-third portion of the said clan with D, E, and F, and the Defendant (G refers to the members of the injured clan) who is the members of the injured clan on December 12, 201. On January 17, 1974, he kept the entire share transfer registration for the injured clan on the ground of the inheritance due to the division of the above forest land on January 17, 1974. On December 20, 201, he arbitrarily sold the said forest land in KRW 20,000,000 from the I certified judicial scrivener office located in the Chungcheongnam-gu, Chungcheongnam-gu, Chungcheongnam-gu, Seoul, and the Defendant (G refers to the members of the injured clan) who is the members of the injured clan. On the same day, on the same day, he embezzled the entire share transfer registration for the said forest land by 1/3.
E Share 1) The above E died on August 24, 1977. 2) The Plaintiff is the Defendant and the deceased E’s heir.
