1. Revocation of a judgment of the first instance;

1. Basic facts

A. On April 23, 1971, registration of preservation of ownership has been made with respect to C Forest land of 47,603 square meters (hereinafter “the instant forest”).

B. The F's share transfer registration was completed on October 1, 1985. 2) On April 7, 1995, the F's share transfer registration was made on March 10, 1983 on the part of the forest land of this case.

C. The aforementioned D’s share transfer registration was completed on January 17, 1974. 2) On December 12, 201, G, on January 17, 1974, on the part of the forest land of this case, on the ground of inheritance due to the consultation and division on January 17, 1974.

3) On December 20, 201, the G shares were registered on the grounds of sale on December 20, 201 in Han River, Inc., Ltd. (hereinafter referred to as “Seoul District Court”), and the said judgment became final and conclusive after the following: (a) G was convicted of criminal facts (hereinafter referred to as “Cheongju District Court Decision 2012No1316: Imprisonment with prison labor: October, 201; 2012No1165: 10 months; 2 years of suspended sentence).

47,603 square meters of the C forest land in the Chungcheongbuk-gun of the crime, is the forest land owned by the same clan that the victim AC clan trusted registered in trust with respect to each one-third share of the above clan D, E, and F. The defendant (G refers to the defendant) who is the member of the victim's clan on December 12, 201, who is the member of the victim's clan, kept the entire share transfer registration for the victim's clan on January 17, 1974 on the ground of inheritance through consultation and division, while he kept the entire share transfer registration for the victim's clan on December 20, 201, at the International Certified Judicial scrivener Office in Chungcheongnam-gu, Chungcheongnam-gu, Seoul., and at the same time, on December 20, 201, at the same day, he arbitrarily sold one-third share of the said forest land in the amount of KRW 200 million, and on the same day, at the Chungcheongnam-gu District Court, the defendant embezzled made the entire share transfer registration for the victim's.
