A defendant shall be punished by imprisonment for not more than ten months.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is a person who operates a press plant with the trade name of Co., Ltd. in Daegu-gu Seoul Metropolitan City;

1. In order to use the funds for the operation of a factory, the Defendant in breach of trust: (a) around January 30, 2012; (b) around February 6, 2012; (c) around 50 million won around March 30, 2012; (d) around April 30, 2012; (e) around 20 million won around April 30, 2012; and (e) on September 18, 2012, he/she was able to repay money to the victim within three months; (b) on March 29, 2012, the Defendant was able to receive the victim’s demand for payment; and (c) on March 29, 2012, he/she was 10,000 won in total at the price of the above borrowed money at KRW 20,000,000,0000; and (d) the Defendant was 130,000,000.

Therefore, the defendant has a duty to keep and manage one set of presses as a good manager's duty of care so that the victim can achieve the purpose of the above transfer security.

Nevertheless, on January 31, 2013, the Defendant violated his duties, and transferred at will 5,8850,000 won in the above plant to the Kaman-knman’s Republic of Korea, and then transferred at will to the Manman’s Republic of Korea. On February 26, 2013, the Defendant received 33,00,000,000 won in the above plant and transferred at will to the Manman’s Republic of Korea.

Accordingly, the defendant acquired property benefits equivalent to 9,1850,000 won in total, and suffered damages equivalent to the same amount to the victim.
