A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On September 6, 2018, the Defendant: (a) sent on the Internet portal site “B”; (b) received a proposal from the Defendant to the effect that “the head of a Si/Gun/Gu shall pay 5% of the withdrawn amount if he/she would collect a e-mail card by withdrawing cash from the e-mail card; and (c) received a proposal from the Defendant to the effect that “the head of a Si/Gun/Gu shall pay 5% of the withdrawn amount if he/she would collect the e-mail from the e-mail card by withdrawing cash from the e-mail card; and (d) received an additional proposal from the Defendant to the effect that “the head of a Si/Gun/Gu shall withdraw money deposited from the e-mail card collected,” and then, “the head of a Si/Gun/Gu shall withdraw money from the e-mail card without charge of money from the e-mail account in order to withdraw the money from the e-mail account in which the e-mail and the e-mail account would be deposited with the e-mail account.

2. In using and managing a means of access, no person shall borrow or lend a means of access while demanding, demanding or promising compensation, or keep, deliver or distribute a means of access, or use a means of access for a crime, or lend or lend a means of access or keep, deliver or distribute a means of access knowing that it is to be used for a crime, unless otherwise expressly provided for in other Acts;

Nevertheless, on September 11, 2018, the Defendant was ordered to collect Kwikset Service Packing’s package from “G” to a high-speed comprehensive terminal located in the center of Manyang-dong, Yongsan-gu, Gyeonggi-do. On September 11, 2018, and around September 12, 2019, the Defendant received and kept one copy of the bank check (credit card number: I) in the name of H sent from the above high-speed comprehensive terminal with express bus freight.
