A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[criminal history] On November 26, 2010, the Defendant received a summary order of KRW 1,50,000 from the Seoul Southern District Court to a fine of KRW 1,50,000 as a crime of violating the Road Traffic Act, and on August 8, 2016, the Defendant received a summary order of KRW 2,00,000 as a crime of violating the Road Traffic Act (drinking driving) in the support of the Suwon District Court of Seoul Southern District Court of Korea.

[Criminal facts] On October 27, 2020, the Defendant driven Cbmw car from around 1km to the front road of the Incheon Bupyeong-gu, Incheon, in a state of alcohol concentration of 0.157% among blood transfusion around 23:08 on October 27, 2020.

Accordingly, the Defendant violated Article 44(1) of the Road Traffic Act at least twice.
