A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
[Criminal record] On November 8, 2017, the Defendant was sentenced to six months of imprisonment due to fraud, etc. at the Gangnam Branch Branch of the Chuncheon District Court on March 4, 2018, and completed the execution of the sentence at the Gangnam Prison.
[Criminal facts] The Defendant did not have any intent or ability to pay the price because he did not have any money under way.
1. On July 11, 2018, the Defendant: (a) around 14:27, 2018, at the D cafeteria operated by the Victim C (24) B located in the East Sea (24) as if he would normally pay the amount to the victim; (b) ordered drinking and food to the victim; and (c) received 1/27,00 of the total amount of 27,00 won from the damage.
2. On July 15, 2018, around 14:10 on July 15, 2018, the Defendant: (a) placed the victim in the “G” restaurant operated by the Victim F in the East Sea as if the victim would normally pay the price; (b) placed an order for alcohol and food; and (c) received KRW 28,00 in total from the injured party, 1 bottle, and 3 Byung.
3. On July 15, 2018, the Defendant, at around 16:10 on July 15, 2018, committed an act as if the Defendant would normally pay the victim the price to the “J cafeteria” operated by the victim I located in the East Sea, and ordered drinking and food to be provided with 10,000 won in total from the victims.
4. On July 21, 2018, at around 13:30 on July 21, 2018, the Defendant: (a) placed the victim at the “M” restaurant operated by K in the East Sea as if he would normally pay the victim the price; (b) placed an order for alcohol and food; and (c) received KRW 21,000 in total from the injured party, 1,000, and 4 bottles.
Accordingly, the defendant was informed of the victims to receive property.
