The grounds of appeal are examined.

1. As to the grounds for appeal by both parties on the violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Bribery) by Defendant A and the part on the grant of bribe by Defendant B

A. We examine the Defendants’ grounds for appeal.

1) The crime of bribery is a legal interest that protects the purchase of a non-performance of duties based on the process of performance of duties and the trust in society. Since there is no need to take into account the existence of a breach of duty or a solicitation in recognizing a bribe, there is no need to consider the existence of a breach of duty or an illegal act, and there is no need to leave before and after the receipt of money and valuables and the performance
