A defendant shall be punished by imprisonment for not more than ten months.
Reasons
Punishment of the crime
1. Fraud;
A. On January 10, 2017, the Defendant: (a) around 03:32, at the main point of “E” operated by the victim D in Busan Jung-gu, Busan, the fact was committed as if the Defendant had no intent or ability to pay the price to the victim; (b) ordered alcoholic beverages, etc.; and (c) obtained and acquired alcoholic beverages, etc. equivalent to KRW 105,00 in total from the damaged person’s market price.
B. On February 1, 2017, around 18:25, the Defendant: (a) by deceiving the victim G in the Seo-gu Busan Metropolitan City F in the same manner as that described in paragraph (1) at the H “H” restaurant where he works as an employee; (b) obtained the victim’s alcohol from the damaged person in total amounting to KRW 44,00,000.

On February 1, 2017, the Defendant, at around 21:30 on February 1, 2017, by deceiving the victim in the same manner as that set forth in paragraph 1 from the “K” dan operated by the victim JJ in Seo-gu, Busan, and by deceiving the victim through receiving alcohol equivalent to the total market value of KRW 90,000 from the damaged person.

On February 1, 2017, around 22:00, the Defendant, at the main point of “N” operated by the victim M in Seo-gu, Busan, by deceiving the victim by the same method as that described in paragraph 1, and acquired the alcohol, etc. from the damaged person, which is equivalent to the total market value of KRW 101,00,000.
E. On February 1, 2017, around 23:20, the Defendant, at the main point of “ Qu” operated by the victim P in Seo-gu Busan, Busan, by deceiving the victim by the same method as that set forth in paragraph 1, and by deceiving the victim, he/she was provided with alcohol equivalent to KRW 38,000 in total market value from the victim.

On February 2, 2017, the Defendant: (a) around 00:20 on the N station located in Busan Seo-gu L, Busan, demanded the victim R (46 tax) to pay the alcohol value; (b) the Defendant was in time of vision, and (c) had the victim’s face with the victim’s face with the driver’s face with the driver’s face with the driver’s face, and had the victim’s face with the driver’s face with the driver’s face with the victim’s face.
