A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant committed the following crimes with weak mental and physical disorder due to a mental fission, etc.:

1. On February 10, 2017, the Defendant assaulted the Victim E (V) who is the female employee of the above main shop, who was in contact with the Defendant at the room of “D” located in Seongdong-gu, Sungwon-si, Sungwon-si, Changwon-si, and who was scheduled to be in contact with the Defendant at the room of “D”, and assaulted the said Victim at the room of the room.

2. Fraud;

A. The Defendant ordered alcoholic beverages, etc. as if he would pay the drinking value to the Victim F, who is the head of the above “D” station, even though the facts were not in an intention or ability to pay the drinking value at the time and place indicated in paragraph 1, and then acquired them by being provided with 1 Byung, 200 won in total from the above victims and obtained them.

나. 피고인은 2017. 2. 14. 20:30 경 창원시 성산구 G 빌딩 2 층에 있는 피해자 H 운영의 ‘I’ 주점에서 사실은 술값을 지불할 의사나 능력이 없었음에도 위 피해자에게 마치 술값을 지불할 것처럼 행세하면서 주류 등을 주문하여 이에 속은 피해 자로부터 합계 776,000원 상당의 임 페리 얼 퀀 텀 1 병, 잭 다니엘 1 병, 주 피트 1 병 등을 제공받아 이를 편취하였다.

On March 14, 2017, the Defendant: (a) around 02:00, at the main point of “L” working for the victim K on the fifth floor of the Sungwon-gu J building in Changwon-si, Sungwon-si; (b) the Defendant ordered alcoholic beverages as if he would pay the alcohol value to the said victim although he did not have the intent or ability to pay the alcohol value; and (c) the Defendant received three service providers, etc. of the total sum of KRW 116,00 from the victims and acquired them by deception.

3. On February 16, 2017, at night, the Defendant: (a) intruded into the victim’s room 118 heading room, where the victim’s O was living, and then 1.5 million won at night; (b) 1.5 million won at the victim’s market price; and (c) 30,000 won at the market price.
