Reasons

Punishment of the crime

On April 21, 2019, at around 21:55, the Defendant reported that waste bags containing industrial rooms, shoes, etc. are installed on electric telegramss at the front of Seongbuk-gu Seoul Metropolitan Government, thereby causing public danger by setting fire to the waste bags.

Summary of Evidence

1. Partial statement of the defendant;

1. A report on the occurrence of a fire;

1. A report on investigation (Attachment of CCTV data at a place of crime) and the private CCTV images attached thereto, and CCTV images for crime prevention;

1. Application of Acts and subordinate statutes to fire site photographs;

1. Article 167 (2) and (1) of the Criminal Act and Article 167 (1) of the same Act concerning the applicable criminal facts, the choice of fines;

1. Articles 70 (1) and 69 (2) of the Criminal Act for the detention of a workhouse;

1. The defendant and his defense counsel on the assertion of the defendant and his defense counsel under Article 334(1) of the Criminal Procedure Act of the provisional payment order asserts that the defendant and his defense counsel have smelled in a garbage bag which is located below the baton of the baton, and they have not been able to bring in it.
