Defendant shall be punished by imprisonment with prison labor for not more than two months and by imprisonment for not more than five years with prison labor for the remainder of crimes.

Punishment of the crime

(Criminal Power) On May 19, 2017, the Defendant was sentenced to imprisonment with prison labor for one year and ten months for the purpose of fraud, obstruction of the performance of official duties by deceptive means, etc. at the Suwon District Court, and the judgment became final and conclusive on July 27, 2017, and completed the execution of the sentence on April 14, 2018.

(2018 Highest 1037) On July 2012, the Defendant misrepresented the identity of a public official to the victim B (L, 40 years old) who was aware of the fact that he had forged a public official identification card under the name of the National Emergency Management Agency at the site of forgery of identification card on behalf of the Defendant, and used it with a credit card obtained from the victim.

Around July 2012, the Defendant forged official document: (a) requested the production of a public official certificate on the condition that he pays a commission of 1.50,000 won to a person who is not in charge of the name who operates the website by forgery of his identification card to the Defendant’s residence located in Yongsan-gu, Yongsan-gu, Gyeonggi-do; (b) on the front side of his official identification card, the Defendant’s photograph and name are printed; (c) on the back side, the Defendant’s photograph and name are printed; (d) “public official identification card”; (d) “position 6(F); (e) “Name”; (e) “HP: G; (e) “H”; and (e) a public official identification card indicated as “person with the first acquired emergency

Accordingly, the defendant forged a public official certificate in the name of the National Emergency Management Agency, which is an official document.

2. On August 23, 2018, the Defendant presented to B a question as to whether he/she is a fake fire-fighting official in front of the I apartment path at an innju City, stating that he/she is a fire-fighting official in the name of the National Emergency Management Agency that he/she would be a fire-fighting official in front of the I apartment path at an innju City, and used the forged official document as if he/she actually issued one copy of the official identification card under the name of the National

3. The fraud accused is a victim’s “fire-fighting public official is entitled to receive a welfare card” at the time and place indicated in paragraph 2, and the credit card in four possession is registered as a family card of a fire-fighting official.
