A defendant shall be punished by imprisonment for one year.
1,261,60 won shall be additionally collected from the defendant.
Reasons
Punishment of the crime
On June 5, 2014, the Defendant was sentenced to one year of imprisonment with prison labor for a violation of the Act on Specialized Credit Financial Business at the Seoul Central District Court on February 23, 2015.
Despite the fact that the Defendant is not a narcotics handler, the Defendant traded, or assisted the sale of, the Metepha (one philophone, hereinafter “philophone”), which is a local mental medicine, as follows:
1. On July 23, 2015, the Defendant: (a) received a request from Denman C to seek phiphones; and (b) consented to the request; (c) on July 23, 2015, the Defendant 750,000 won in cash from D; and (d) arranged to purchase and sell phiphones in the non-furcing telephones with approximately 0.8g of philopons on the same day to C in the non-furcing telephones in the Suwon-dong transfer-dong on the same day.
2. On July 30, 2015, the Defendant: (a) received a request from Denman C to seek phiphones; and (b) consented to the request; (c) on July 30, 2015, the Defendant arranged to trade phiphones by means of sending 750,000 won in cash to D in the vicinity of E located in the Gu of Annsan-si, Annsan-si; and (d) on July 30, 2015, 000 won in cash to D; and (c) 0.8g of phiphones on the same day, the Defendant arranged to trade phiphones in the flue-dong on the same day.
3. On August 13, 2015, the Defendant: (a) received a request from a police officer of early 2015 to request the purchase and sale of phiphones; (b) accepted the request; and (c) 400,000 won in cash from G nearby the F in the window of Changwon-si on August 13, 2015 to G; and (d) received approximately 0.8 g of phiphones from H in the vicinity of the Hanam-gun of the same day, and arranged for the purchase and sale of phiphones from H in the same day.
4. On October 9, 2015, the Defendant of the crime committed around October 2015: (a) received a request from a policeman C to request scoponon; and (b) accepted such request; and (c) made cash at the time of hand-on hand-on hand-on hand-on hand-on hand-on hand-on on October 9, 2015 on October 9, 2015.
