Punishment of the crime

[2017 Gohap 88] The Defendant is a person who has been engaged in steel product distribution business under the trade name of “E” in Daegu Seo-gu D.

On April 201, the Defendant received steel products from G Co., Ltd. (hereinafter “victim Co., Ltd.”) located in G Co., Ltd. (hereinafter “Co.”), in cash transaction (e.g., payment and supply of products), and made the Victim Co., Ltd believe that the said “E” is an enterprise capable of normally paying the said price, and received steel products by means of credit transaction and acquired them by fraud.

The Defendant, around June 201, at a restaurant where the trade name near the above “E” office is unknown, offered K commercial buildings as security, the security value of which is equal to KRW 500 million in the value of the security next to the J high school under the name of the Defendant, if the Plaintiff’s H factory general manager sells the steel products to a private person I by normal transaction (the last day of the following month after the goods are supplied on credit).
