All appeals and supplementary appeals are dismissed.
The costs of appeal are assessed against the Defendant, respectively.
Reasons
We examine the grounds of appeal and the grounds of incidental appeal.
An appeal may be filed with the Supreme Court with respect to cases falling under small claims prescribed in Article 2 (1) of the Trial of Small Claims Act and Article 1-2 of the Rules on Trial of Small Claims only in cases where grounds prescribed in Article 3 of the Trial of Small Claims Act exist.
However, in the instant case where it is obvious that the appellant is a small amount of claim, the argument in the grounds of appeal and the grounds of appeal for the incidental appellant are satisfied, and therefore, the allegation in the grounds of appeal for the incidental appeal does not constitute the grounds of permission for the final appeal as stipulated in
Therefore, all appeals and incidental appeals are dismissed, and the costs of appeal and incidental appeal are assessed against each party. It is so decided as per Disposition by the assent of all participating Justices on the bench.
