Reasons
Punishment of the crime
The Defendants are partners, from January 2016 to December 201 of the same year, with the trade name of “H hotel” from Dongdaemun-gu Seoul Metropolitan Government to “H hotel”.
Defendant
A from around 2015 to around 2015, in operating “I”, which is a hotel consulting company, provided operating expenses in the way of “I” to Defendant B, who became aware of inher name, by obtaining a number of credit cards to be issued in his/her name before leaving about KRW 3 to 40 million losses.
Defendant
A around May 2015, at Anyang-si, attempted to meet the damage while operating the “J”, but to provide KRW 100 million deposit, which led to the situation in which, while receiving a high interest loan from the lending companies, such as K and Russn Lnb, Mountain, Mussn, and well-beingcom, it would be difficult to pay the price for the card in return.
The Defendants decided to start a new business by leasing a H hotel in order to resolve the increase in Jel and to use the bond in order to prevent the return of the card, and at the same time to pay a larger amount of money to the time.
The Defendants, while borrowing money necessary for the operation of a hotel from the persons with whom they would borrow money, Defendant A would not speak Defendant B to the obligees that the financial situation of H’s hotel difficult to reach.
The defendant B also agreed to show to the creditors all the data related to revenue, such as sales account books.
1. The Defendants conspireded with the victim L to obtain the pecuniary benefits of KRW 33 million in total by deceiving the victim L as follows.
A. Defendant A, at a H hotel office around February 29, 2016, may enter into KRW 2-30 million per month with L.
The principal shall be paid in KRW 200,000 equivalent to the interest of KRW 2% per month if the principal needs to be paid in operating H hotel, and the principal shall be paid in three months thereafter.
