Reasons
Punishment of the crime
"2018 Highest 2450"
1. On February 25, 2018, around 20:00 on February 25, 2018, the Defendant discovered one copy of the victim E-owned physical card and embezzled the property that he/she left the possession of the victim.
2. On February 25, 2018, the Defendant violated the Act on Financial Business Specializing in Fraud and Credit Business: (a) exercised the e-mail card acquired as stated in paragraph (1) at the H convenience store in the operation of the Dobong-gu Seoul Metropolitan Government F Victim G, as if he were the Defendant’s card; and (b) exercised the e-mail card as if she was the Defendant’s card, and was issued a tobacco amounting to KRW 4,000 from the non-personal employees, and used another person’s e-mail

1. On June 8, 2018, the Defendant: (a) on June 21, 2018, up to 21:00, the Defendant: (b) placed the victim K’s market value, which includes one card, one card, and one new card, etc., and brought to the view that he/she had, on his/her own, without following necessary procedures such as returning one card to the victim K.
As a result, the defendant embezzled the property that escaped from the possession of the victim K.
2. Denating him by presenting one (1) a card in the name of K as if he were his own credit card, and he received 100 won tobacco equivalent to the market value of 40 million won from the above employee, and then he paid 40 million won with the said card in the name of K.
In addition, the Defendant used the credit card in the name of K which was lost on three occasions from June 8, 2018 to September of the same month as in attached Table 1, as in attached Table 1, and received the total amount of 9,300 won from the victim M.
