1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Facts of recognition;
A. A. On November 1, 2012, a party status-based net C (D students; hereinafter “the deceased”) died while being under dental treatment (hereinafter “instant treatment”) by a dentist who works in a dental clinic (hereinafter “Defendant Hospital”) from Defendant B, who was working in a dental clinic (hereinafter “Defendant Hospital”). The Plaintiff is the mother of the Deceased.
Defendant Hyundai Marine Fire Insurance Co., Ltd. (hereinafter “Defendant insurance company”) is an insurer who entered into an insurance contract of KRW 50,000,000 with respect to Defendant B’s medical liability for medical compensation with the Korea Dental Association and the Defendant B as the insured.
B. Defendant B, for the first time on October 26, 2012, conducted dental treatment with respect to the deceased who was within the Defendant Hospital’s internal hospital and dental treatment (hereinafter “the instant medicine”), conducted a diagnosis of the deceased’s 16,00 pulama X-ray photographs, etc. on the part of the deceased, and conducted a diagnosis of the deceased’s 16th day on the same day on the part of the deceased’s 16th day (hereinafter “the instant medicine”).
(2) On October 29, 2012 and October 31, 2012, Defendant B provided dental treatment to the deceased for the purpose of anesthesia. At each time the treatment was conducted, Defendant B used the instant medicine for anesthesia, and the deceased did not have any special abnormal response.
C. The process of the treatment of this case and the deceased’s death 1) around 15:51 on November 1, 2012, Defendant B, around 15:51 on, and around the 27th day of the deceased, she conducted anesthesia to treat the deceased, and as in the previous method, she was infecting the medicine of this case on the part of the deceased. 2) The deceased showed an abnormal pulmonary function at around 15:55, after anesthesia, around 5 minutes of the anesthesia. The deceased showed an abnormal pulmonary resuscitation from around 15:57, the Defendant B directly performed pulmonary resuscitation to the deceased, and the rescue unit members who arrive at the Defendant Hospital from around 16:03 to the deceased as an emergency hospital.
