1. Basic facts

A. On March 26, 2013, the Plaintiff developed a smartphone display system (hereinafter “D”) between F Co., Ltd. (hereinafter “B”) and B, barring any special circumstance, and supplied B with the instant fishing system to April 15, 2013, and supply B with services related to the instant fishing system from April 16, 2013 to April 15, 2015. B provided the Plaintiff with services related to the operation and maintenance of the instant fishing system with KRW 20 million from March 29, 2013 to April 15, 2015 (hereinafter “C”) and KRW 300,000,000,000,000,000,0000 and KRW 3030,000,000 from April 15, 2013 to KRW 30,300,000,000,000,000,00.

B. At the time of April 3, 2013, the Plaintiff requested that the Defendant, who was a director of B, “B, without paying the price of KRW 20 million until March 29, 2013, pay the price of KRW 20 million.” Accordingly, the Defendant prepared and issued the payment note (Evidence 6, hereinafter “instant payment note”) as follows to the Plaintiff:

Company and Class: The F director's amount of 20 million won: On April 15, 2013, the Defendant undertakes to comply with the following provisions with respect to the amount not paid out of the transaction price supplied by the Plaintiff (the service development price: the service development price, smart fishing additional service development contract deposit) supplied by the Plaintiff:

1. The above amount shall be paid by the date of payment;

2. Where the payment is not made by the due date, overdue interest (25% per annum) for the accounts payable from the following day to the date of full payment shall be additionally paid.

3. Article 16 of the Act on the Protection of Personal Information of Public Institutions and Enforcement Decree of the Resident Registration Act, if the amount is unpaid.
