Defendant
A is a person who actually operates E and Defendant C and Defendant D Co., Ltd. established for the purpose of importing quasi-drugs, etc., and Defendant B is a representative director of Defendant C Co., Ltd. who is in charge of trade, business, etc. in the above two corporations and E.
Defendant
C and Defendant D are corporations established for the purpose of selling therapeutic devices, etc. imported from E to domestic hospitals.
1. Joint crimes committed by Defendants A and B;
(a) A person who intends to import drugs, etc. in violation of the Pharmaceutical Affairs Act as a business shall obtain permission or file a report with the Minister of Food and Drug Safety for each item;
On November 27, 2017, the Defendants conspired to import 16,00 domestic business 16,00 (3,00,000,000,000 won, 1,329,083,00 won at the market price) among the domestic size of "10cmX7.5m-8p" that has been destroyed to the head of Busan customs office without reporting item from the Minister of Food and Drug Safety through employees of the said customs service corporation’s office at the office H office in Jung-gu Busan Metropolitan City.
As a result, the Defendants imported drugs, etc. to the Minister of Food and Drug Safety in the business of importing drugs, etc. without reporting item items, etc.
From November 27, 2017 to February 29, 2018, the Defendants conspired to import drugs, etc. from that time, and imported 138,00 domestic business operators and 12,00 (3,519,238 won in total, 22,558,457 won in cost) without reporting item items, etc. to the Minister of Food and Drug Safety, as shown in the attached Table 1 of Crimes List.
(b) No person who imports goods from a foreign country in violation of the Customs Act shall import goods without meeting requirements for permission, approval, recommendation, certification, or other conditions necessary for import in accordance with Acts and subordinate statutes or import goods by unlawful means;
