A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

No one shall provide game water for distribution or use, or display or store for such purposes, with any content different from the rating classified by the Game Water Management Committee.

이에 피고인은 C와 공모하여 2015. 5. 1. 경부터 2015. 5. 6. 경까지 대구 달성군 D 2 층에 있는 ‘E’ 라는 상호의 게임 장에서 ‘NEW( 뉴) 쥬라기’ 게임 기 40대를 설치하고, C는 위 게임기에 당초 등급 분류 받은 내용에 없는 별도의 점수 정산기능, 손님들이 어느 한 순간에 대량으로 점수를 획득할 수 있는 연타기능을 갖추어 게임기 조작 버튼 위에 게임 자동 진행장치인 일명 ‘ 똑딱이 ’를 올려놓으면 게임이 자동으로 실행되면서 우연적이고 자동적으로 손님들이 획득한 점수가 누적되도록 하였고, 피고 인도 위와 같이 원래 게임의 내용과 다르게 게임기가 작동된다는 사실을 알면서도 이를 손님들의 이용에 제공하였다.
