1. However, even if the defendant did not possess a galloned mobile phone and received the price from the victim, he did not have the intention or ability to send the mobile phone to the victim.

On July 28, 2012, the Defendant received 280,000 won from the victim to the national bank account in the name of the Defendant at around 08:09.

Accordingly, the defendant was given property by deceiving the victim.

2. At around 17:00 on October 17, 2012, the Defendant made a false statement to the victim S, who reported the mobile phone advertising comments posted by the Defendant on the Internet NVV Q QK page, and made a telephone call contact to the Defendant, stating that “First, the Defendant would send 40,000 won to B at home if he transfers it to B.”

However, even if the defendant received the payment from the victim, he did not have the intention or ability to send the mobile phone to the victim.

On October 17, 2012, the Defendant received 440,000 won from the victim to the national bank account in the name of the Defendant at around 17:32.

Accordingly, the defendant was given property by deceiving the victim.

On October 23, 2012, 2012, the Defendant: (a) reported on October 23, 2012, 2012, the letter posted by the victim to “purchase V contact Book” on the Internet Nene U car page; and (b) made the victim contact with the victim to sell in KRW 230,000.”
