A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is the former spouse of the victim B (here, 32 years of age) who was divorced on April 2018, and is the father of the victim C (ma, 8 years of age).

1. On April 20, 2020, the Defendant violated the Act on Special Cases Concerning the Punishment, etc. of Crimes of Domestic Violence (hereinafter “Special Cases”) received a provisional protection order stating that “The Defendant issued an order to prohibit access within 100 meters from the residence of the victim B located in Ansan-si, a member D until the time when the victim’s protective order is determined, and ordering the victim’s Handphone or e-mail address not to transmit signs, text, sound, or images by wire, wireless, optical, or other electronic means.”

Nevertheless, at around 12:30 on May 17, 2020, the Defendant violated the temporary protection order by entering the victim's residence located in Ansan-si, a member of the Dong-gu.

2. The Defendant violated the Child Welfare Act (child abuse) committed assault by the victim C on the floor of hand on the ground that the victim C cannot be aware of his/her door at the time and place set forth in the above paragraph (1). Accordingly, the defendant committed physical abuse against the victim who is a child, and committed emotional abuse that harms the mental health and development of the child.

3.
