Defendant

A shall be punished by imprisonment for eight months.

Provided, That with respect to Defendant A, the above punishment shall be imposed for two years from the date this judgment becomes final and conclusive.

1. 성매매알선등행위의처벌에관한법률위반(성매매알선등) 피고인들은 2019. 3. 11.경부터 2019. 5. 9.경까지 모바일 어플리케이션 ‘즐톡’을 통하여 불특정 다수에게 성매매 광고를 하여 이를 보고 연락하는 손님들에게 성매매 여성들의 사진과 함께 ‘마사지코스 A☞40분 1샷 ￦100,000, B☞60분 1샷 ￦120,000, C☞70분 1샷 마사지 핸플 ￦140,000, D☞90분 1샷 마사지 핸플 ￦160,000, E☞ 120분 1샷 마사지 핸플 ￦200,000, 연애코스 A☞40분 1샷 ￦100,000, B☞60분 1샷 ￦120,000, C☞70분(2샷) ￦150,000, D☞90분(2샷) ￦170,000, E☞120분(2샷) ￦200,000'이라는 내용 등으로 문자메시지를 전송하고, 이에 손님이 성매매 여성을 선택한 후 모텔 장소를 알려주면, 성매매 대금으로 10만 원 내지 12만원을 받고 피고인 B이 C 차량으로 미리 고용한 태국 국적의 D(여, 34세)를 손님이 알려준 장소에 데려다준 후 성교행위를 하도록 하였다.

As a result, Defendants conspired to act as a broker for commercial sex acts.

2. No person who violates the Immigration Control Act shall employ any person who has no status of sojourn eligible for employment activities, as prescribed by Presidential Decree;

그럼에도 피고인들은 공모하여 위와 같이 ‘즐톡’을 통하여 성매매 알선업을 하면서, 2019. 3. 11.경부터 2019. 5. 9.경까지 사증면제(B-1)자격으로 입국하여 취업 체류자격이 없는 태국 국적의 D(여, 34세)를 성관계 1회당 7만원을 지급하는 조건으로 위 성매매 업소의 종업원으로 고용하였다.
