A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

On June 14, 2013, the Defendant sentenced the Busan District Court to eight months of imprisonment for the obstruction of performance of official duties, etc., and completed the execution of the sentence on September 20, 2013.

On October 7, 2013, at around 05:10, the Defendant was arrested as a flagrant offender with assault D in the position of the Busan Youngdo Police Station and the Assistant E, who was called out after receiving a report of the assault case occurred in the boom-gu, Busan Metropolitan City.

피고인은 같은 날 05:30경 부산 영도구 F에 있는 G파출소에서, 부산영도경찰서 소속 경사 H으로부터 피의자 조사를 받자 이에 불만을 품고 위 H에게 “야이, 십할놈아, 너거들 뭐야, 너거들 다 죽고 싶나, 너거들 자식 새끼들, 씨까지 다 죽이겠다, 그래 녹음해라, 개새끼야, 너거들 자손새끼들까지 다 죽인다.”고 협박하고, 파출소 책상위에 있던 사무용품, 서류철, 컴퓨터 모니터를 바닥에 집어 던지고 이를 제지하던 경찰관들을 때릴 듯한 태도를 보이고, 계속하여 부산영도경찰서 소속 경위 I에게 “개새끼들, 니는 반드시 내가 죽인다, 내가 감옥에 다녀오면 틀림없이 너 뿐만 아니라 니 자식들까지 다 죽인다.”라고 말하고, 위 H에게 다시 “얼굴을 기억해 놨다, 틀림없이 다 죽일테다, 명심해라, 개새끼야.”라고 말하고, 부산영도경찰서 소속 경위 J에게 “십새끼들, 내 니 집구석까지 싹쓸이 해 주마, 내가 학교 갔다 올 동안 잘 지내고 있어라.”라고 말하고, 위 D, 위 E에게 “너거들 새끼, 다 죽인다, 지랄들하고 있네, 내가 누군지 아나, 내가 너거들 신상명세 다 알고 있다, 조심해라.”라고 말하는 등으로 위 경찰관들을 협박하였다.

Accordingly, the defendant interfered with the legitimate execution of duties of the police officers in criminal investigations.
