A defendant shall be punished by imprisonment for three years.

However, the execution of the above punishment shall be suspended for four years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is a person who is in office as the head of the F Headquarters and has provided living counseling services through home visits of persons with disabilities.

1. Indecent acts by compulsion of a victim G (or female and 12 years of age);

가. 피고인은 2011. 2. 23. 19:00경 경기 가평군 H 소재 ‘I’ 사무실에서, 목욕을 마치고 나온 피해자에게 “잘 씻었나 보자”라고 말하면서 손으로 피해자의 배를 만지고, “어깨를 쫙 펴야 가슴이 예뻐진다”라고 말하면서 손으로 피해자의 가슴을 만져 피해자를 강제로 추행하였다.

나. 피고인은 2011. 6. 5. 11:00경 서울 중랑구 J 아파트 1002동 513호 소재 피해자의 주거지에서, 피해자에게 “바지 속에 뭘 입었느냐 ”라고 말하면서 피해자의 팬티 속으로 손을 집어넣어 음부를 만져 피해자를 강제로 추행하였다.

C. On June 29, 2011, the Defendant, at around 19:00, committed an indecent act by force against the victim by holding the victim seated above knee in the Defendant’s knee, saying, “I are well hnefing at school, I are well hnefing at school.”

2. Indecent acts by compulsion of a victim K (n, 12 years of age);

가. 피고인은 2011. 3. 12. 13:00경 위 G의 주거지에서, 그곳에 놀러온 G의 친구인 피해자에게 “여자는 너무 살찌면 안 된다, 너는 살을 조금 더 빼면 예쁠 것 같다”라고 말하면서 손으로 피해자의 가슴과 허리를 만져 피해자를 강제로 추행하였다.

B. On April 12, 2011, the Defendant, at around 20:20 on April 12, 2011, committed an indecent act by force against the victim, stating that “G was unaware of her horse, her arm’s length, and so on.”

C. On May 3, 2011, the Defendant, at around 20:00, committed an indecent act by force against the victim by inserting the victim’s hand in the victim’s clothes while stating that “at least how much suicide had been taken.”
