1.(a)
Defendant
A shall be punished by imprisonment for ten months.
(b) except that the above sentence shall be executed for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
Defendant
A is the business owner of "F", which is in the second floor of Ulsan-gu E, Ulsan-gu, and play a role in managing the profit of the said business establishment and securing women in commercial sex acts. Defendant B and Defendant D, as an employee, play a role in responding to customers and cleaning the said business establishment, and Defendant C had a role in inducing customers to the said business establishment through a guest act.
1. No one shall arrange, solicit, induce or compel sexual traffic in return for promising the Defendants to receive money, valuables or other financial benefits for the business of arranging sexual traffic, in violation of the Punishment of Arrangement of Commercial Sex Acts, etc.;
Nevertheless, Defendant A conspired with Defendant B, Defendant C, and Defendant D, from August 1, 2018 to January 1, 2019; Defendant C from March 2019 to March 2, 2019; Defendant D from April 2019 to May 2, 2019 to “F”; and Defendant D installed six rooms equipped with simple beds and bathing facilities, and shared such roles as above, and arranged sexual traffic by having employees G, H, I, etc. of Chinese nationality, a female sexual traffic, receive KRW 100,00 to 200,00 in return for sexual traffic from customers not having been registered.
As a result, Defendants conspired to arrange sexual traffic for business purposes.
2. Defendant A - No person who violates the Immigration Control Act shall employ any foreigner who has no status of sojourn eligible for employment activities.
Nevertheless, the Defendant, on the condition that I, a foreigner who did not have the status of sojourn that he/she could work from around April 30, 2019 to May 12, 2019, should be paid 50,000 won per marina, as an employee of the relevant marina business establishment, as well as three Chinese workers who did not have the status of sojourn that he/she could work like the list of crimes in the attached Table, are the employees of the relevant marina business establishment.
