Punishment of the crime

1. 피고인은 2016. 4. 18.경 불특정 다수의 사람이 통행하는 구미시 D에 있는 E병원 앞 도로에서, 위 E병원에서 내시경을 받는 과정에서 S자 결장 부위에 천공이 발생하였다고 생각하고, 피해자를 비방하기 위하여 ‘여러분 장기는 안녕하십니까, 저는 E병원에서 대장 내시경 후 저녁부터 복통 및 고열이 동반되어 C/T촬영을 하니 창자에 구멍이 났다고 해서 응급수술까지 하였습니다. 그런데 병원은 책임 없다고 하네요, 의료사고 없는 병원 잘 선택하세요, 어제는 나였지만 오늘은 당신의 소중한 분이 다칠 수 있습니다. 양심을 버린 의사한테 당신의 소중한 몸과 귀한 가족을 맡기시겠습니까 양심도 없는 인간이 뭘 한다고! 구미에 병원은 많고 많습니다’라는 피켓을 몸에 걸고 1인 시위함으로써 공연히 사실을 적시하여 피해자의 명예를 훼손하였다.

2. On April 20, 2016, the Defendant injured the victim’s honor by openly pointing out facts by putting the clicket, “I find out after an emergency operation due to a hole in the E hospital’s inner diameter after an emergency operation, I find it possible to avoid the responsibility of the hospital, and to select a hospital with no medical malpractice,” on the front of the above E hospital, where many unspecified persons pass through, and on the ground of paragraph (1).
