The part of Defendant C’s fraud regarding Q, AT,O, and BE is reversed.
Reasons
1. According to the evidence submitted by the prosecutor including Defendant C, AY, and AX’s statements with the summary of the grounds for appeal, the court below acquitted all the Defendants on the charge, although the Defendants could sufficiently recognize the fact of deceiving the victims as stated in the facts charged in the instant case. The court below erred by misapprehending the facts, which affected the conclusion of the judgment.
2. Determination
A. The summary of the facts charged is the representative director of the I Co., Ltd., a movable company of the planning department (hereinafter “I”); Defendant B, a person who served as the chief of the I’s overall headquarters; and Defendant C, a person who served as the chief of the I’s overall headquarters.
1) Defendant A and Defendant B, while serving as the representative director and the head of the headquarters, paid 10% of the purchase and sale amount of land to the head of the division, who is a sales employee of the land, and paid 20% of the sales commission to the head of the headquarters, the head of the headquarters, the head of the headquarters, and the head of the headquarters, etc. 10% of the sales commission paid to the head of the headquarters, and 10% of the sales commission paid to the head of the headquarters.
