1. Basic facts

A. The Defendant newly constructed a detached house in Busan District District Office C (hereinafter “instant house”), and the Plaintiff purchased the instant house from the Defendant and resided from December 31, 2013.

B. From August 2014, water leakage and mycoi in the inside and outside of the instant house (hereinafter “instant defect”) began to occur, and the Defendant directly performed repair work, but did not improve.

C. On April 2015, the Plaintiff: (a) requested another construction business entity to perform waterproof construction works; (b) received the estimate of the construction cost of KRW 1,113,000; and (c) the Defendant paid KRW 1,000,000 to the Plaintiff.

Even after water leakage and mycoin continue to occur, the plaintiff requested D, a specialized company for the repair of wood houses, to perform the construction work on the estimate of KRW 19,601,00 for the repair of defects and the removal of the causes of water leakage.

가. 손해배상책임의 발생 살피건대 갑 제2호증의 2의 기재, 제3호증의 내용증명서에 첨부된 사진과 제10호증의 각 영상 및 변론 전체의 취지에 의하면, ① 원고 가족이 피고가 신축한 이 사건 주택에 입주한 지 8개월 만에 안방 천정에 곰팡이가 발생하기 시작하여 옷방 천정, 벽면으로 확산되었으며, 화장실 천정 배관부위에서 누수가 발생하는 하자가 발생하였고, 원고가 뒤늦게 하자보수공사를 위하여 샤시, 옷방 천정 석고보드 등을 제거해보니 창틀 나무 등이 �어 있었던 사실, ② 이러한 하자의 원인에 대하여 D의 대표가 지붕에서 흘러내린 빗물 또는 이슬의 결로가 방과 테라스 경계를 타고 스며들어 안방 천정의 장선과 바닥부재를 썩게 하였고, 지붕 끝 지점 마감재의 여유가 없어 빗물이 바로...
