A defendant shall be punished by imprisonment for two years.

Criminal facts

On November 27, 2009, the Defendant was sentenced to three years in the Seoul Central District Court for the violation of the Act on the Aggravated Punishment, etc. of Specific Crimes, and one year in the Seoul Central District Court for habitual larceny on June 18, 2015. On October 25, 2016, the Defendant was sentenced to two years in the Seoul Central District Court for habitual larceny and completed the execution of the sentence in the military prison on August 31, 2018.

1. Violation of the Aggravated Punishment Act;

A. At around 19:00 on May 7, 2019, the Defendant put the victim D, who is a person in charge of security team, into a bank with clothes and food corresponding to KRW 535,980 in total, by taking advantage of the gaps where surveillance of the victim D, who is a person in charge of security team, was neglected.

나. 피고인은 2019. 6. 9. 22:12경 서울 중구 E에 있는 F매장 앞 노상에서 마침 지퍼가 열려있는 숄더백을 어깨에 메고 걸어가는 일본인 관광객인 피해자 G를 발견하고, 피해자 뒤로 다가가 숄더백 안에 손을 넣은 후 그곳에 있던 피해자 소유 현금 200,000원이 들어있는 시가 미상 지갑 1개를 꺼내어 가져갔다.

As a result, the Defendant was sentenced to punishment twice or more due to larceny, etc., and habitually stolen another’s property within three years after the execution of the sentence is completed.

2. On May 7, 2019, the Defendant violated the Resident Registration Act: (a) arrested a flagrant offender in the I districts located in Eunpyeong-gu Seoul Metropolitan Government H as larceny and used another person’s resident registration number illegally by speaking his/her k’s resident registration number, who was in a usual fluence without the consent of K’s friendly fluence, who was requested to present his/her identification card by the police officer.

3. On May 7, 2019, the Defendant, at the Seoul Western Police Station and the office located in Eunpyeong-gu, Seoul Western Police Station, 757 for the unification of Eunpyeong-gu, Seoul, and thereafter, was investigated as a suspicion of larceny, and signed and sealed each of the following on the confirmation column of the suspect’s interrogation statement and the investigation process confirmation confirmation document from the above police station L superintendent.
