A defendant shall be punished by imprisonment for one year.
However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Consumed facts D Co., Ltd. (hereinafter “D”) and E Co., Ltd. (hereinafter “E”) have been operating as a company that actually engages in pre-paid phone-related business (hereinafter “pre-paid phone business”) by being entrusted with the opening of pre-paid phone, pre-paid card sales, shock, etc. by a telecommunications company, KSK link, etc.
On January 2, 2012, the Defendant became a head of the business of the above company run by F, the Defendant, who was employed by F, the Defendant, and was in charge of business management, filed an application for a prepaid phone by stealing the name of foreigners on November 7, 2014, and was detained on charges of taking part in opening fees. As such, from November 8, 2014, the Defendant was practically in charge of general management of the said company.
In the case of foreigners, the Defendant provided foreigners who wish to purchase the pre-paid phone in the name of E without knowledge of such circumstances in order to avoid restrictions that allow them to purchase the pre-paid phone from three days after entry into Korea. After three days, the Defendant forged an application for change of the pre-paid phone name in the name of foreigners and sent it to foreigners without obtaining any separate consent from foreign customers, thereby raising the performance of the pre-paid phone name by changing the name of the pre-paid phone from E to E.
2. Criminal facts (fix of private documents and the use of the investigation document) on April 3, 2015, the Defendant entered “I” in the name column, “I” in the passport number column, and “I” in the customer column under the name of the applicant, and signed the application for change of the name of the pre-paid telephone at the D and E offices located in Yongsan-gu Seoul, Yongsan-gu, Seoul and H, H, 202. At that time, the Defendant entered the application for change of the name of the pre-paid telephone link in the name column, “I”, “J” in the passport number column, and “I” in the customer column under the name of the applicant, and then completed the application for change of the name of the pre-paid telephone through online.
