Punishment of the crime
The personal information has been leaked to an unspecified victim as a whole of the Bophishing organization, which led the victim to withdraw money from the account and keep it in the house, and the domestic officers in Korea receive or instruct the victim to do so, and the defendant conspireds to steals or defraud the victim's property by taking a stolen or receiving the money withdrawn from the victims' residence according to the direction of the victim's name in accordance with the direction of the victim.
1. The “9” as stated in the facts charged on June 19, 2015 appears to be a clerical error.
At around 10:00, when making phone calls to victims C (n, 55 years of age) as if they were employees of post offices and prosecutor's offices, the victim made a false statement that "the bank from which personal information has been leaked is likely to be withdrawn, making all of the withdrawals to be kept in a house air conditioners", and made the victim withdraw a total of 6,774,271 won of deposits deposited in 10 accounts such as community credit cooperatives, etc., and let the victim keep them in a cooling house in the residence of the victim in Echeon-si-si-si-si-si-si-si-si-si-si-si-si-si-si-si-si-si, and led the victim to go out of the above residence by finding out the identification number of the resident registration, and making a false statement to read "a Dong office to renew
At around 15:00 on the same day, the Defendant entered the current identification number received from an unqualified person in accordance with his/her name, and entered the residence of the above victim, and took 28,000,000 won out of cash stored in the cooling house in the above residence, and stolen it.
Accordingly, the defendant stolen the victim's property in collusion with the person who was not the victim of the name.
2. On June 24, 2015, the person under whose name the person under whose name the personal information has been leaked to the victim E (n, 71 years of age) at the French site and engage in such activities as if he/she was a post office employee and police officer belonging to the branch police station, and as such, “the money in bank where the personal information has been leaked.”
