Reasons
Punishment of the crime
The Defendant has been engaged in the store management duty at Gangnam-gu Seoul Metropolitan Government D's four-day shop shop from October 201 to June 2012.
1. The Defendant for embezzlement of credit card sales proceeds received KRW 24,382 from November 11, 201 to receive deposits from the national bank account in the name of the Defendant and consumed personal debt repayment, etc., by changing the credit sales proceeds account of the credit card company to the national bank account (F) in the name of the Defendant on November 11, 201.
In addition, from around that time to June 19, 2012, the Defendant consumed the total of KRW 33,312,698 by the same method over 93 times as indicated in the annexed crime list.
2. Around April 10, 2012, the Defendant borrowed KRW 28,00,000 from a future mutual savings bank at the said four-day shop.
The Defendant deposited KRW 23,100,000 to the Agricultural Cooperative (E) account under the name of the Defendant, while keeping loans for the said Company, but the remaining KRW 4,900,000 was arbitrarily consumed for personal purposes, such as living expenses and repayment of personal debts, and embezzled it.
3. Around June 4, 2012, the Defendant: (a) transferred KRW 490,000 to the national bank account (F) in the name of the Defendant while keeping four-day shop revenues from the Agricultural Bank (E) account, which is an entrepreneur of the four-day shop; (b) transferred KRW 320,000 in the same way from the French land on June 7, 2012; and (c) embezzled KRW 93,000 in the same way from the French land on June 12, 2012 by arbitrarily consuming KRW 93,00 in the same way as in the same manner; and (d) embezzled KRW 903,00 in the aggregate for personal purposes, such as living expenses and repayment of personal obligations.
