A defendant shall be punished by imprisonment with prison labor for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant, from around October 2011, was serving as an insurance solicitor from “B”, and was serving as an insurance solicitor from “C” from around October 2018, and around March 2012, the victim D and the victim knew to each other while subscribing to insurance from the Defendant.
1. Around December 29, 2017, the Defendant committed embezzlement: (a) around December 29, 2017, at the F department store store in Busan, Daegu, Busan, the Defendant received KRW 30 million from the victim’s Busan, to the Busan, Busan, the Defendant paid KRW 10 million to the Defendant’s Busan, and (b) paid KRW 40 million,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000, from the Defendant’s Busan, on or around December 30, 2017; (c) paid KRW 38,000,00,000,000,000,000,000,000,000,00,00,00.
Accordingly, the defendant embezzled the victim's property.
2. Around March 20, 2018, the Defendant committed embezzlement: (a) around March 20, 2018, at the place specified in paragraph (1); (b) around March 20, 2018, the Defendant: (c) stated that “The Defendant would subscribe to the 18-month I Savings Insurance with the maturity of 18 months; (d) the Defendant would pay 1.2 million won per month to the Company; and (e) the Defendant would return the profits in the form of interest per month; and (e) received money from the victim to the Busan Bank Account (H) under the name of the Defendant for the purpose of insurance premium and kept the money in custody; and (e) around that time, the Defendant used the money voluntarily from the Busan Gan District to pay for living expenses and personal obligations.
Accordingly, the defendant embezzled the victim's property.
3. The Defendant committing embezzlement around December 27, 2018 shall be the victim, at the place specified in paragraph (1) around December 27, 2018, and shall be the victim.
