[전제사실] 전화금융사기(일명 ‘보이스피싱’) 범죄는, 사기 범행을 하기 위해 유인책, 관리책, 현금수거책, 송금책 등 여러 단계를 조직하는 ‘총책’, 무작위로 불특정 다수의 피해자들에게 전화를 하여, ‘계좌가 범죄에 이용되었다’는 등으로 피해자들을 속여 피해자들로 하여금 위 사기단에서 사용하는 계좌로 돈을 송금하도록 유인하는 ‘유인책’, 위챗 등 채팅앱을 통해 자신들이 고용한 현금수거책에게 구체적인 범행 지시를 하는 등 하부 조직원들을 기능적으로 관리하는 ‘관리책’, 위 관리책의 지시에 따라 사기단 사용 계좌에서 피해금을 인출하여 이를 다른 현금수거책 내지 송금책에게 전달하거나, 관리책이 지시하는 계좌로 입금하는 ‘현금수거책’, 현금수거책으로부터 피해금을 전달받아 이를 환전소 등을 통해 보이스피싱 조직에서 관리하는 계좌로 송금하는 ‘송금책’ 등으로 각자의 역할을 분담하고 있다.
