A defendant shall be punished by imprisonment for not less than one year and six months.

The defendant pays 2,00,000 won to D who is an applicant for compensation.

Punishment of the crime

"2015 Highest 1978"

1. Fraud;

A. At around 13:10 on May 23, 2015, the Defendant made a false statement to the “G office” operated by the victim F of the victim F in Yongsan-gu, U.S., U.S. E, that the Defendant would pay the Defendant the cost of using the phone to the Defendant.

However, at the time of fact, the defendant did not have any fixed income, and there was no intention or ability to pay the expenses even if he received and used the car from the victim without any specific property.

Nevertheless, as above, the Defendant: (a) by deceiving the victim as above; (b) did not pay KRW 3,500,000,000 of the price for the use of the HA car by the victim until June 11, 2015; and (c) acquired pecuniary benefits equivalent to the same amount by failing to pay the said amount; and (d) did not pay KRW 4,750,000,000 in total of the price for the use of the car from the 4 rental car company in the same manner from July 12, 2015 by the same method from July 1 to July 4, 2015.

B. On June 5, 2015, the Defendant posted a notice stating that he/she sold the right to use an additional digital club site on the Internet “the following Scambae club site” at an infinite place, and falsely concluded that the Defendant would transfer the above right to use if he/she wired the price to the victim I.

However, the defendant did not have the above right to use the Gu, and even if he received the payment from the victim, he did not have the intention or ability to transfer the above right to use to the victim.

Nevertheless, the Defendant, as seen above, by deceiving the victim, and acquiring 150,000 won from the victim as the transfer price for the right to use, and by making a false statement from that time to June 11, 2015 that he/she sells a middle-standing machine by the same method or by making a false statement.
