Reasons
Punishment of the crime
[Criminal Justice] On July 20, 2018, the Defendant was sentenced to two months of imprisonment and five months of imprisonment for fraud at the Daegu District Court on August 17, 2018, and was released from detention by a permanent prison on August 17, 2018. On October 18, 2018, the said judgment became final and conclusive, and the execution of the sentence was terminated.

1. On September 11, 2018, the Defendant, at the victim B, posted a letter that “S9 shall be sold at the galloning S9 at the Internet medium transaction site E bulletin board at the Internet seller’s address,” and the victim B (Nam, 20 years of age) who reported and contacted this article “I would deliver smartphone payments to the Defendant’s bank account (G).” The Defendant received 460,000 won from the victim to the F bank account (G) in the name of the Defendant and obtained pecuniary benefits equivalent to the above amount.
2. On November 11, 2018, the Defendant, at the JPC located in the Gu, Sinsi, Sinsi, published a false statement to the effect that “Aphone 8 is sold” on the Internet’s website E bulletin board, and reported and contacted the statement to the victim H, who received KRW 50,000 from the said victim’s bank account (G) from the said victim to November 26, 2018, the Defendant received KRW 550,00 from the said victim’s bank account (G) and acquired property benefits by obtaining KRW 1,155,000 from the total three victims under the same several laws as indicated in the attached Table (1)-2 through (4).
3. Gambling;
A. On January 9, 2018, the Defendant deposited KRW 300,00 in the Internet illegal gambling site (K) account in the name of L, which is necessary for drawing points, by connection with the Internet illegal gambling site (K) at the seat address of the Gyeongbuk-gun, G, and D address around January 9, 2018, and deposited at least 57 points over 57 points, as described in the attached Table (2) through the three gambling site point charging account by October 18, 2018.
