A defendant shall be punished by imprisonment for not less than eight months.

The defendant shall receive 115,00 won from the defendant to B who is an applicant for compensation, and C who is an applicant for compensation.

On August 18, 2015, the Defendant was sentenced to two years of suspension of the execution of imprisonment with prison labor for fraud at the Jung-gu District Court on August 18, 2015, and on March 28, 2017, the suspended execution was revoked and the parole period was expired on March 30, 2018 in a female prison on April 23, 2018. On December 5, 2018, the Defendant was sentenced to one year and two months of imprisonment with prison labor at the Seoul Northern District Court on December 20, 2019 and completed the execution of the sentence at the Seoul Northern District Court on August 20, 2019. On July 26, 2019, the Defendant was sentenced to one year of suspension of the execution of imprisonment with prison labor for a violation of the Telecommunications Business Act at the Seoul East District Court on April 3, 2019 and the judgment becomes final and conclusive on August 3, 2019.

Criminal facts

[2019 Highest 2480] Around August 28, 2019, the Defendant posted a false statement to the effect that “The sales of the Orccushion flag” on the bulletin board of the Internet community “F KafG”, a mobile phone at the Defendant’s home located in Namyang-si, Namyang-si, and the Defendant’s house located in the Defendant’s home, and reported it to the effect that “the remittance of the payment would send the Orculbus to the victim B.”

However, the defendant thought that he would use the money remitted from the victim for the cost of living, and there was no intention or ability to sell the above money to the victim.

Nevertheless, the Defendant, by deceiving the victim as above, received KRW 115,00 from the victim to the post office account (H) in the name of the Defendant on the same day, and by deceiving the victims in a total of 23 times from August 26, 2019 to September 23, 2019, as described in the attached Table 1, and by deceiving the victims by the said method, and by deceiving them to receive KRW 3,152,00 from the victims.

[2019 Highest 2699] The Defendant, around September 13, 2019, runs away on the bulletin board of “F Kapet”, which is an Internet community site, using a mobile phone from the Defendant’s home located in Namyang-si, Nam-si, and the Defendant’s home located in subparagraph (e).
