1. The Plaintiff’s Defendant is related to the goods supplied from January 28, 2014 to August 21, 2014, according to the sales status of the attached Form.
Reasons
1. Basic facts
A. The Plaintiff is a person who runs wholesale and retail business of PEchips, etc. under the trade name of "C", and the Defendant is a person who manufactures and sells PE lighting, etc. under the trade name of "D."
B. During the period from January 28, 2014 to August 21, 2014, the Plaintiff supplied the Defendant with the LED chips (hereinafter “instant LE chips”) and the PCB chip, etc. (hereinafter “the instant LE chips, etc.”) imported from the manufacturer of China from China under the same transaction conditions as indicated in the attached sales status. The Defendant supplied the instant LE chips, etc. supplied by the Plaintiff to the E (hereinafter “E”) by placing them on the PC chip, etc. supplied by other companies, and connecting them with the contact.
C. The Defendant informed the Plaintiff of the fact that there was a defect in the instant LED chips, etc. from the summering point of January 2014 to the effect that the request for A/S was chaind by E, and the Plaintiff did not comply with the Plaintiff’s request, which would result in the return of the returned PCB machine and the consortium, from among the goods supplied to E around January 2015.
On the other hand, on September 29, 2014, the Plaintiff sent the following funding plans (hereinafter “instant funding plan”) to the Defendant regarding the defects of the instant ESchips, etc. asserted by the Defendant.
