The defendant's appeal is dismissed.

1. The summary of the grounds for appeal (a factual error) did not intentionally assault C by the victim.

2. The victim made a statement that corresponds to the facts constituting the crime at the lower court.

The photograph taken by the victim part of the body attached to the investigation report (No. 5) shall support the victim's legal statement.

Although the defendant alleged that he had no intention, in consideration of the situation of the occurrence of the case, the act of carrying the victim's breath and sticking with stick is recognized as an intentional act.

There is no error in the judgment of the court below that affected the judgment.

3. The appeal by the defendant is without merit.

The dismissal under Article 364 (4) of the Criminal Procedure Act is dismissed.
