A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. From June 25, 2012 to April 18:40, 2013, the Defendant: (a) at the “D” adult product store operated by the Defendant in Chungcheongbuk-gun C, the Defendant: (b) had the intent to sell to many and unspecified customers for KRW 10,000 per head; (c) had the mec uniformed; and (d) kept four CD copies containing images containing the content of sexual intercourse or self-defense by a woman manifestly seen as 10,00 in body or appearance.
Accordingly, the Defendant possessed child and juvenile pornography for the purpose of selling them.
2. No person other than a pharmacy founder who violates the Pharmaceutical Affairs Act may sell medicines or acquire them for the purpose of sale;
Nevertheless, from June 25, 2012 to April 18:40, 2013, the Defendant acquired the Defendant’s “D” adult product stores operated by the Defendant in Chungcheong-gun C from around 25, 2012 to April 26, 2013 for the purpose of sale in total of KRW 5,000 per opening the 28th unit of fake and fake pen (name of the goods) from an unqualified person.
3. No person who violates the Trademark Act shall possess goods identical or similar to designated goods bearing another person's registered trademark for the purpose of transferring or delivering such goods without the right to use the trademark;
Nevertheless, from June 25, 2012 to April 18:40, 2013, the Defendant: (a) at the “D” adult product store operated by the Defendant in Chungcheong-gun C; (b) at the same time, the Defendant: (c) at the same time, the Defendant: (d) the chemicals for treating the functional disorder of the U.S. to an unspecified number of customers; and (d) the chemicals registered by the U.S. C. as the designated goods with the “Viagle” attached with the registration number No. 40-0387168; and (e) the fake Bara and the U.S. L. L.C. car company located in the U.S. as the designated goods for the prevention of sexual functional disorder to the Korean Intellectual Property Office; and (e) at 5,000 won per 1,00 won per 5,00,000, per 1,000.
