피고인들은 같은 날 21:00경 스마트폰 채팅 어플인 ‘즐톡’에 접속하여 성매수자를 구한 후, 피해자로 하여금 구미시 K에 있는 L모텔에서 불상의 남성을 상대로 성매매를 하게한 다음 청소년과 성매매를 하였다는 것을 빌미로 위 불상자로부터 돈을 요구하려고 하였으나 위 불상자가 이를 눈치 채고 화를 내는 바람에 실패하고 그대로 피해자와 함께 도주하였다.
