Defendant shall be punished by a fine of KRW 3,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

On August 21, 2016, at around 16:10, the Defendant driven a DNA 2 km vehicle without obtaining a driving license, from the front day of the Kuam-si, in the city of Changwon to the front day of the window relay of the Changwon-si, to the front day of the oil station, from the front day of the Kuam-si, which is located in the city of Changwon-si.

The reason for sentencing under Articles 70(1) and 69(2) of the Criminal Act with the custody of a workhouse is that the Defendant committed the instant crime even though the judgment became final and conclusive on June 19, 2015 and is still under the suspension period, the Defendant committed the instant crime is a reason for sentencing unfavorable to the Defendant.

It seems that the Defendant would not drive without a license again, such as selling the instant vehicle, etc.; the Defendant did not drive without a license; the Defendant was relatively old; the Defendant was sentenced to imprisonment with prison labor for six months since the suspension of execution of the previous sentence is invalidated and suspended when the sentence is finalized in this case; and the Defendant appears to be too harsh, taking into account the sentencing conditions stipulated in Article 51 of the Criminal Act, such as the Defendant’s age, character and conduct, motive, means and consequence of the crime, and the circumstances after the crime, etc., the Defendant shall be sentenced to the same fine as the order. However, the Defendant clearly warns the fact that there is no more preference if the same act is repeated once more.
